| 1. | Any servant or agent of the consignor shall be liable for such loss if the loss is caused by fault or neglect on his part .

| 5. | Where an action is brought against the servant or agent of the actual carrier , the provisions contained in paragraph 2 of article 58 and paragraph 2 of article 59 of this code shall apply

| 6. | The claimant shall bear the burden of proof regarding the fault of the carrier or his servant or agent , with the exception , however , of the circumstances specified in paragraphs 3 and 4 of this article
