The conditional form grants gratuitously to the contracting party only those concessions originally made gratuitously to a third party and grants concessions originally obtained as part of a bargain only under equivalent conditions or in return for equivalent gains 有条件最惠国待遇是只向缔约国无偿提供那些原先无偿提供给第三国的待遇，和只在同等条件下或为换取同等利益的情况下，向缔约国提供原先作为交易的一部分而获得的优惠。
