| 4. | With the drug supply certificate , the wholesaler and the retailer shall be registered with the administrative agency for industry and commerce
药品批发、零售企业凭《药品经营许可证》到工商行政管理部门办理登记注册。 |
| 5. | Any newly established drug retailer shall be subject to approval and be granted the above certificate by the local drug regulatory agency at or above the county level
开办药品零售企业，须经企业所在地县级以上地方药品监督管理部门批准并发给《药品经营许可证》 。 |
| 6. | Any newly established drug wholesaler shall be subject to approval of the local drug agency of the government of the province , autonomous region or municipality directly under the central government and be granted the drug supply certificate
开办药品批发企业，须经企业所在地省、自治区、直辖市人民政府药品监督管理部门批准并发给《药品经营许可证》 |
| 7. | No drugs other than the chinese crude drugs may be sold at fairs in urban and rural areas , but drug retailers holding the drug supply certificate may , within the specified business scope , sell such drugs at the stores they set up at the fairs
城乡集市贸易市场不得出售中药材以外的药品，但持有《药品经营许可证》的药品零售企业在规定的范围内可以在城乡集市贸易市场设点出售中药材以外的药品。 |
| 8. | Article 100 if a pharmaceutical production license or a pharmaceutical trade license is revoked according to this law , the pharmaceutical supervisory and administrative department shall notify the industry and commerce administrative department to alter or annul the registration
第一百条依照本法被吊销《药品生产许可证》 、 《药品经营许可证》的，由药品监督管理部门通知工商行政管理部门办理变更或者注销登记。 |
| 9. | Article 97 a pharmaceutical supervisory and administrative department shall perform its duty of supervision and inspection according to laws and regulations , and shall supervise the production and trade of the enterprises which have obtained a pharmaceutical production license or a pharmaceutical trade license according to the regulations of this law
第九十七条药品监督管理部门应当依法履行监督检查职责，监督已取得《药品生产许可证》 、 《药品经营许可证》的企业依照本法规定从事药品生产、经营活动。 |
| 10. | The establishment of pharmaceutical retail enterprises must be sanctioned by local authorities for the supervision and control of pharmaceuticals at or above the county level , which will issue a pharmaceutical trade license , on the basis of which registration at the industry and commerce administrative departments shall be conducted
开办药品零售企业，须经企业所在地县级以上地方药品监督管理部门批准并发给《药品经营许可证》 ，凭《药品经营许可证》到工商行政管理部门办理登记注册。 |
